1) Who are the members of this union? All Clinical Officers of Kenya {a clinical officer hereafter shall refer to any person who holds a diploma in clinical medicine and surgery, higher diploma in clinical medicine specialty or bachelors degree in clinical medicine from a recognized training institution} are eligible to become a full member. Students under taking Bachelors and Diploma courses in Clinical Medicine are also eligible to become associate member. There will be room for honorary membership.

2. Who is a Clinical Officer? A clinical officer (CO) is a mid-level practitioner of medicine in East Africa and parts of Southern Africa who is qualified and licensed to perform general medical duties such as diagnosis and treatment of disease and injury, ordering and interpreting medical tests, performing routine medical and surgical procedures, and referring patients to other practitioners.The training, registration and licensing of Clinical officers is highly regulated by the government through Clinical Officers Council(COC)].

3. what is "CAP 260" 'CAP 260' is an Act of Parliament(Kenya) that makes provision for the training, registration and licensing of clinical officers; to regulate their practice and for connected purposes.The act on Commenced 31 July 1989 and it now considered to be outdated and it is said to restrict the output of Clinical officers.

4) What is the relationship between UKCO and KCOA?

KCOA is a professional body that deals with welfare of clinical officers in Kenya. Although KCOA has done a lot of commendable work since its inception it is no a trade union and as thus it has massive legal limitations that this union will not have. It is envisaged that UKCO as a trade union shall give clinical officers a platform to push for their agendas.Experts in matters of trade unions believe that if KCOA and UKCO join hand they can streamline clinical medicine profession to be more effective in its roles & for the betterment of not just us but also for the future generations of C.Os to come. it is a necessary and inevitable action point, but that does not mean that we forego the association. We shall have both.

5) What are the benefits of a TRADE UNION?

a. A TRADE UNION will give us a common, audible and compelling voice – a very powerful tool that we could use to weigh in on health policy matters and matters surrounding OUR welfare as Clinical Officers'

b. A TRADE UNION is common body which will stand up for our rights as Clinical Officers– alone, we are each at the mercy of our employers. This has often translated into unemployment, slavery during internship period, poor renumerations, among others. Collectively & as a UNION, we shall meet such breeches of clearly laid out procedures and regulations with a greater force than the perpetrators would have even envisaged in nightmares.

c. Better terms of service – The union is empowered to negotiate for better terms of service that will allow acceptable working hours and access meaningful healthcare when sick.

d. End exploitation – Slave labour ended in the 19th century. What were its hallmarks? Could someone please tell me how different SLAVERY is from the state of THE CLINICAL OFFICER INTERNS who are collectively paid a total of zero shillings per Year while on the other hand they run medical services in the entire hospital. This is just one of the many glaring examples on how we as clinical officers have been unfairly marginalized & taken for granted by government of Kenya.

6. What does the Kenyan Constitution say about Trade unions ?

The following are the key articles of the new constitution of Kenya that pertains our RIGHTS on matters concerning a TRADE UNION;-

Section 33. (1) Every person has the right to freedom of expression, which includes—

(a) freedom to seek, receive or impart information or ideas;

36. (1) Every person has the right to freedom of association,

which includes the right to form, join or participate in the activities of

an association of any kind.

37. Every person has the right, peaceably and unarmed, to

assemble, to demonstrate, to picket, and to present petitions to public

authorities.

41. (1) Every person has the right to fair labour practices.

(2) Every worker has the right—

(a) to fair remuneration;

(b) to reasonable working conditions;

(c) to form, join or participate in the activities and programmes

of a trade union; and

(d) to go on strike.

(4) Every trade union and every employers’ organisation has the

right—

(a) to determine its own administration, programmes and

activities;

(b) to organise; and

(c) to form and join a federation.

(5) Every trade union, employers’ organisation and employer has

the right to engage in collective bargaining.
